By accessing our site or making a purchase, you agree to be bound by these Terms. Please read them carefully, as they outline the rights and responsibilities of both you, our valued customer, and Air Plant World.

Our mission is to provide you with a seamless, transparent, and delightful experience, mirroring the natural beauty and simplicity of the air plants we nurture. These Terms are designed with clarity and care, ensuring you understand our mutual commitments.

1.1 Access and Acceptable Use

You are granted permission to access and use our website for personal, non-commercial shopping purposes. You agree not to misuse the site, including attempting to interfere with its security or functionality.

1.2 Intellectual Property Rights

All content on this site, including but not limited to text, images, logos, product designs (for Ceramic containers, Cork Bark displays, Terrarium Glass, etc.), graphics, and the overall “look and feel,” is the property of Air Plant World or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

2.1 Product Nature and Variations

We specialize in live Air Plants (Tillandsia), including varieties like Ionantha, Large Air Plants, and Small Air Plants, as well as complementary Tools, Containers (Ceramic, Cork Bark, Grapevine), Hanging Pendants, Terrarium Kits, and Specialty/Sealife items.

• Live Plants: As living organisms, each air plant is unique. Slight variations in size, shape, and color from website images are natural and part of their charm.
• Color Enhanced Air Plants: These are specially treated plants. Their enhanced colors are unique and may differ from screen images due to monitor settings. They are considered final sale due to their distinctive treatment.
• Handcrafted & Specialty Items: Items like Ceramic pots, Sealife decorations, and Terrarium glass are often hand-finished. Minor imperfections are not defects but characteristics of artisan craftsmanship.

2.2 Product Availability

All products are subject to availability. We reserve the right to limit quantities and discontinue items at any time.

3.1 Order Acceptance

Your order constitutes an offer to purchase. Acceptance of your order and formation of a contract occur when we send you an order confirmation email.

3.2 Pricing and Payment

Prices are listed in US Dollars. We accept the following payment methods: Visa, MasterCard, JCB, and PayPal. You represent and warrant that you have the legal right to use your chosen payment method.

3.3 Shipping and Delivery

We ship globally, excluding some remote regions and parts of Asia as determined by our carriers.

• Processing: Orders are processed within 1-2 business days after payment confirmation.
• Standard Shipping: $12.95 via DHL/FedEx. Delivery within 10-15 business days after shipment.
• Free Shipping: Available on orders over $50 via EMS. Delivery within 15-25 business days after shipment.

Delivery times are estimates and may vary due to destination, customs, and carrier delays. You will receive a tracking number upon shipment. Risk of loss passes to you upon delivery to the carrier.

4.1 Eligibility and Timeframe

Returns and exchanges are accepted within 15 days of the delivery date. Items must be unused, in original packaging, and in resalable condition.

4.2 Non-Returnable Items

To preserve their quality and vitality, the following cannot be returned unless damaged upon arrival:

• Color Enhanced Air Plants (due to their unique treatment).
• Live Air Plants if the packaging seal is broken (for health and safety reasons).
• Sealife & Specialty Items, Custom or Personalized Terrarium Kits & Containers (due to their fragile or custom nature).

4.3 Return Process & Costs

You must contact us at [email protected] within the 15-day window to obtain a Return Authorization (RA) number. Return shipping costs are the customer’s responsibility unless the return is due to our error or a defective item.

4.4 Refunds

Refunds are issued to the original payment method within 5-10 business days after we receive and approve the return. Original shipping fees are non-refundable unless the return is our fault.

Air Plant World’s liability is limited to the fullest extent permitted by law.

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the site or products, including but not limited to loss of profits, data, or opportunity.
• Our total liability for any claim related to your order shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.
• We do not guarantee that the website will be error-free or uninterrupted.
• This limitation does not apply to liability for personal injury or damage to tangible property caused by our gross negligence or willful misconduct, or where consumer protection law prohibits such limitation.

6.1 Governing Law
